Ex-Police Chief Accused Of Soliciting Sex From Man In Public Park Avoids Trial As Lewdness Case Falls Apart

Former Suffolk County Police Chief James Burke is once again making headlines after a judge agreed to dismiss public lewdness and indecent exposure charges tied to a 2023 undercover park sting on Long Island — as long as he stays out of legal trouble for the next six months.

Burke, whose name has long been associated with corruption scandals and controversy surrounding the early investigation into the Gilgo Beach serial killings, had been accused of exposing himself and allegedly soliciting sexual activity from an undercover park ranger at Vietnam Veterans Memorial Park in Farmingville in August 2023. Prosecutors said the case began falling apart after misconduct allegations surfaced involving multiple officers connected to the arrest. According to reports, three park police officers involved in the case either resigned or were terminated, including the ranger who allegedly witnessed the incident.

During the recent court appearance, prosecutors acknowledged they could no longer meet the burden required for trial because of credibility issues tied to those officers. Judge Eric Sachs granted what is known as an adjournment in contemplation of dismissal, meaning the charges will be formally dismissed on Oct. 28 if Burke avoids any further arrests or legal problems.

Burke’s attorney insisted his client maintained his innocence throughout the case and said Burke was relieved to finally move on from the scandal.

The latest development adds another chapter to the dramatic fall of the once-powerful police chief. Burke previously served federal prison time after pleading guilty to civil rights violations and obstruction of justice connected to the beating of Christopher Loeb, a man accused of stealing a bag from Burke’s police vehicle that reportedly contained pornography, Viagra, and sex toys. The scandal ultimately helped expose corruption within Suffolk County law enforcement and led to the conviction of former District Attorney Thomas Spota.

Critics have also long blamed Burke for hindering the early investigation into the Gilgo Beach murders after he reportedly pushed federal investigators away from the case during his tenure as police chief. Years later, authorities arrested and charged alleged serial killer Rex Heuermann in connection with multiple killings tied to the case.
